Defiant gym owner loses in court, fitness center ordered closed

  • David Blondin, who opened his Prime Fitness and Nutrition gym in Oxford despite state guidelines to remain closed, was ordered to close his gym until further notice, according to filing in the Massachusetts state courts systems.

    The temporary restraining order came from Worcester Superior Court Judge Susan Sullivan in an emergency hearing on Friday, June 5. 

    The Town of Oxford, on behalf of the town’s Board of Health, sued Blondin on May 28.

    In a Facebook video posted on May 17, Blondin announced he was reopening his gym.

    “All small businesses need to take a stand and open their doors," Blondin told MassLive in a May 20 article. "This is impacting our businesses and our families.”

    Sullivan’s order reads, in part: “It is ORDERED that the town's emergency motion for a temporary restraining  order is ALLOWED and the defendants, along with their agents, servants, employees, and all others in active concert with any of them, are ENJOINED from operating the gym and fitness center at the property located at 1 Norwood Court, North Oxford, Massachusetts, until permitted to do so under any executive order issued by the Governor.”

    On Monday, Sullivan denied Blondin’s motion for a stay in the order. Later in the day, the town filed a Verified Complaint for Civil Contempt again Blondin and Prime.
